HIRE TERMS AND CONDITIONS
We are committed to offering you classy and unusual finishing touches for hire to make your special event memorable.
Terms used by us are defined as follows:
“goods” “order/s” or “item/s” include vases, candelabras, table number holders, cake stands and any other products listed that are offered for hire.
HIRE AGREEMENT
These Terms and Conditions form part of our Hire Agreement with you.
By entering into this agreement, you the hirer, are confirming that you have read, understood and agree to be bound by the terms within.
These are the only terms and conditions upon which we will contract with you. No alteration or substitution to these terms and conditions shall be valid unless agreed in writing.
QUOTE REQUEST
We will respond to all online enquiries within two (2) business days to discuss details of your request.
You will then be sent a Quotation and Hire Agreement form within two (2) business days of our initial discussion. The Quotation will be valid for a period of thirty (30) days from the date of issue
The Quotation and Hire Agreement will be based on your provisional number of items required, and will specify the deposit amount required to secure the goods. Final numbers MUST be confirmed twenty-eight (28) days prior to the Hire Date.
The Quotation does NOT secure the goods for you until you have signed our Quotation and Hire Agreement form and paid the required deposit. This will then constitute placing an order with Events 2 Celebrate for the hire of these goods.
HIRING CHARGES
Charges quoted are for a one (1) day hire charge. Weekend hire rates are applied as a one day hire charge. It is assumed that weekend hires will be delivered Friday and returned Monday unless otherwise stated. Longer hire periods are available and are quoted on an individual basis.
ORDERS
Accepting the Quotation and placing an Order with us by completing our Hire Agreement constitutes your acceptance and understanding of our Hire Terms and Conditions.
Completion of the Hire Agreement shall not guarantee acceptance of the Order by Events 2 Celebrate and reservation of the required items until the deposit payment has been received by us. We will confirm in writing when your order has been accepted.
We reserve the right to substitute an item for an alternative design if losses or breakages have occurred as a result of a previous hire of the item. You will be advised of any necessary substitutions prior to the dispatch of your Order.
The Hire Agreement will specify the Hire Date and Time, and an agreed Collection Date and time. Additional charges may be levied if the items are not available for collection at these agreed times.
PAYMENTS
All Items hired will require a 50% deposit at the time of the booking to secure the Order. If the required Hire Date is within twenty-eight (28) days of placing your order, full payment will be required at the time of the Order.
Once you have confirmed the final numbers of items required for hire, you will be advised of the balance required for payment for the Order. The balance of the total Hire Price (inclusive of the delivery cost and Security Bond) is due for payment twenty-eight (28) days prior to the Hire Date.
Payments will be accepted via PayPal, cash or bank transfer only.
If the balance payment is not received we reserve the right to withdraw our acceptance of your order. No delivery of goods will be made without receipt of the balance.
If you wish to hold your hired goods for longer than the contracted period, please contact us in advance to discuss terms and conditions.
SECURITY BOND
A Security Bond must also be provided with the final payment at least twenty-eight (28) days prior to the dispatch of the goods. The sum of money is dependent upon the goods hired and the value of the Order, and is held as a refundable deposit against the safe and prompt return of the hired items.
The security bond will be refunded within two (2) to three (3) business days following the return of the items in original condition.
DELIVERY AND COLLECTION
Deliveries will be made in person by an Events 2 Celebrate representative, or in some cases or by our designated courier service. If applicable, delivery charges will be specified in the Quotation based on the location of the venue.
All deliveries and collections are made during normal business hours unless otherwise arranged. In some instances items can be collected from our premises by prior arrangement.
You, or your authorised agent, will be required to inspect and sign for the goods at the time of delivery. Any person other than the hirer who signs a delivery/collection note at the venue is deemed to be the authorised agent. Any discrepancies to the order must be notified IMMEDIATELY. Any discrepancies that are NOT notified within twenty-four (24) hours of the delivery will be deemed to be either lost or damaged and therefore will be subject to additional charges.
Please be aware that the goods remain your responsibility until they have been collected by Events 2 Celebrate, or by our designated courier service. You should therefore make every effort to ensure goods are kept dry and that they are retained in a secure place until this time.
Hired goods must be returned in their original packaging and packaged in accordance with the guidelines supplied. Failure to do so may result in breakages and therefore incur charges against your deposit. For health purposes, all equipment must be free of food residue and wiped with a damp cloth. Please ensure that all items are dry prior to placing in the packaging. An additional charge may be assessed for non-compliance with these guidelines.
Items not available for collection on the agreed date, time and location will incur an additional charge of 25% of the listed hire price per item per day.
We will make every effort to collect and deliver your order at the specified times, however we will not be liable for any loss arising directly or indirectly from any delay in the delivery or collection of the goods.
DAMAGED AND LOST ITEMS
Items hired by you shall remain in your care and you, the hirer, shall remain responsible for any loss or damage to the property of Events 2 Celebrate caused by clients, guests and invitees.
All damaged items remain the property of Events 2 Celebrate and should therefore be returned. Substitute items will not be accepted.
The replacement cost of all losses and damages will be deducted from the refundable Security Bond. If the cost of the items lost or damaged is more than the amount of the Security Bond, a further invoice will be issued for the balance of the replacement cost.
CANCELLATION AND CHARGES
If, for any reason, you wish to cancel your order you should telephone Events 2 Celebrate immediately. All cancellations, or reductions in numbers of items to be hired, must then be confirmed in writing and will only become effective on receipt of your cancellation email or letter.
As it is unlikely that these goods can be re-hired for your date, a cancellation charge will be levied for loss of business. This charge will be based upon the value of the balance owing and the time left before the Hire Date as follows:
• Cancellations made from twenty-eight (28) days prior to the date of delivery will be exempt from a cancellation charge. Note your Deposit is non-refundable but no charge will be levied against the balance owing.
• Cancellations made less than twenty-eight (28) days prior to the date of delivery will be charged at 50% of the balance owing on the total Hire Cost, with no refund of the Deposit.
• Cancellations made within 7 days of the delivery date will be charged at 100% of the balance owing on the contract price with no refund of the Deposit.
In each case the Security Bond will be refunded.
No refunds or credits will be issued for any items that are returned unused.
RESPONSIBILITY.
Should Events 2 Celebrate be unable to provide the goods reserved due to circumstances beyond our control, no further claim other than an entitlement to a full refund of any deposits paid may be made. We will endeavour to provide you with reasonable notice.
LIABILITIES
In no circumstances shall our liability to you exceed the invoice value of the contract.
Events 2 Celebrate or any of their employees shall not be liable in respect of damages/injury/loss or any other damage incurred in respect of this hire, as a result of any defect or damage to the item and the customer shall satisfy himself/herself of the suitability/condition/placement of the equipment upon receipt.
Caution should be exercised in particular with the use of candles; we shall not be liable for any damage/injury/loss caused as a result of using candles. Permission should be sought from the venue as to the suitability of all items hired.
WARRANTIES
We warrant that at the time of delivery goods will be of satisfactory quality; however we are not liable for any damages or losses incurred during transit.
If for any reason you are not entirely satisfied with your goods your statutory rights are not affected and complaints can be made by telephoning 0404 391182; or made in writing to Events 2 Celebrate, 4 Kendall St, Charlestown, NSW 2290.
OWNERSHIP
All goods remain at all times the property of Events 2 Celebrate, 4 Kendall St Charlestown. NSW 2290.
